Summary: Scissor And Boom Height Access Ltd ("the Company", "we", "us") collects personal information to process enquiries, bookings, account applications and hires. We handle that information in accordance with the Privacy Act 2020. We do not sell personal information to third parties.

1. Information We Collect

We collect personal information you provide directly to us, including through the contact form, the online booking form, the account application form, the customer portal, our AI assistant ("Boom") on the website and over the phone, and any direct correspondence by phone or email. This may include:

  1. Name, phone number and email address;
  2. Company name, NZBN, GST number and business address, where an account application is made;
  3. Delivery address and site access notes for a hire;
  4. Equipment, quantities and hire dates requested;
  5. Trade reference and credit-related information supplied as part of an account application;
  6. The content of messages sent through the contact form, the booking form, the AI assistant, or by phone; and
  7. Technical information collected automatically when you browse the website, such as pages visited and general performance metrics (see clause 4).

2. How We Use Your Information

We use personal information to:

  1. Respond to enquiries and prepare quotes;
  2. Process and fulfil booking requests, including forwarding the details to our fleet management system so a quote and reply can be prepared;
  3. Assess and administer account applications, including making credit enquiries with credit reporting agencies where authorised;
  4. Administer a Hire Agreement, including invoicing, collections, and issuing certificates and documents through the customer portal;
  5. Operate our AI assistant, Boom, which can answer questions and take booking details over the website chat widget and by phone; and
  6. Improve our website and services, including through aggregated, non-identifying analytics.

Where you make an account application, entering into a Hire Agreement is subject to our Terms and Conditions of Hire, which contain further detail on how information collected at that stage is used (see clause 15 of those Terms).

3. Third Parties and Disclosure

We share personal information with the following third parties, only to the extent necessary to provide our services:

  1. Resend — our transactional email provider, used to send enquiry, booking and account-application notifications, and customer portal sign-in links;
  2. Anthropic — the AI provider behind Boom, our website and phone assistant. Messages you send to Boom are processed by Anthropic's API in order to generate a response;
  3. Twilio — our phone provider, used to route and transcribe calls answered by Boom;
  4. Our internal fleet management system, to which enquiry, booking and account application details are forwarded so a quote, invoice or reply can be prepared; and
  5. Credit reporting agencies, debt collection agencies, financiers and trade referees, where you have made an account application or entered into a Hire Agreement, as set out in our Terms and Conditions.

We do not disclose personal information to any other third party except where required by law, to enforce our legal rights, or with your consent.

4. Cookies and Analytics

  1. Our website uses Google Analytics (GA4) to understand how visitors use the site. Google Analytics uses cookies and collects information such as pages viewed and general location.
  2. Our website uses Vercel Web Analytics and Speed Insights, which are designed to operate without cookies and collect only aggregated, non-identifying usage and performance data.
  3. You can control or disable cookies through your browser settings. Disabling cookies may affect some website functionality but will not prevent you from making an enquiry or booking.

5. Data Retention

We retain personal information for as long as reasonably necessary to fulfil the purposes described in this policy, including to comply with our legal, accounting and tax obligations. Information relating to a Hire Agreement is generally retained for at least 7 years in accordance with our record-keeping obligations under New Zealand law.

6. Security

We take reasonable steps to protect personal information from loss, unauthorised access, use, modification or disclosure. No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your Rights

Under the Privacy Act 2020, you have the right to:

  1. Access the personal information we hold about you;
  2. Request correction of that information if it is inaccurate, incomplete or out of date; and
  3. Make a complaint if you believe we have interfered with your privacy.

To exercise any of these rights, contact us using the details in clause 9. If you are not satisfied with our response, you may complain to the Office of the Privacy Commissioner at privacy.org.nz.

8. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. The updated policy will be posted on this page with a revised effective date.
